CONDICIONES GENERALES SERVICIO JOB HUNTER EN EXPANSIONYEMPLEO.COM

PRIMERO:
Por el presente instrumento, el “Cliente”, contrata a La Comunidad Laboral Trabajando Ibérica SLU, CIF B85768067, con domicilio en C/ Duque de Liria 6, 3ºD, 28015, Madrid, en adelante “Trabajando.com España”, la entrega del servicio de asesoría singularizado en el siguiente contrato.

SEGUNDO:
El servicio de asesoría personalizada, en adelante “Job Hunter”, tiene por objetivo otorgar herramientas que potencien la empleabilidad de los Clientes que contratan el servicio, accediendo a un determinado número de Módulos de Empleabilidad, de una temática particular relacionada con el proceso de búsqueda de empleo.
Estos Módulos serán entregados por un Consultor de Empleabilidad, de manera “presencial” (en las oficinas de Trabajando.com España) o “no presencial” (vía telefónica o por video conferencia), dependiendo de lo solicitado por el Cliente al momento de contratar Job Hunter y a la disponibilidad de los medios necesarios para prestar los servicios en una u otra modalidad.
Cada módulo será coordinado y llevado a cabo luego de la comprobación efectiva del pago realizado a través de los medios que Trabajando.com España ponga a disposición del Cliente.
En ningún caso la contratación del servicio de asesoría “Job Hunter” garantiza la obtención de un puesto de trabajo.

TERCERO:
Al contratar cualquier Módulo de Empleabilidad del servicio de Job Hunter, el Cliente contará con una hora establecida y coordinada con el Consultor de Empleabilidad para que dicho(s) módulo(s) sea(n) llevado(s) a cabo. Es de responsabilidad del Cliente garantizar la presencia o comunicación con Trabajando.com España en la(s) fecha(s) y hora(s) asignada(s) para la prestación del servicio.

CUARTO:
Los Módulos de Empleabilidad ofrecidos en el servicio de Job Hunter, según la combinación elegida por el cliente, son:
Módulo 1: Perfil Profesional y objetivos de carrera:
Este módulo de consultoría tiene como objetivo la revisión de la historia laboral del Cliente, con un Consultor de Empleabilidad, analizando en conjunto su experiencia y conocimientos relevantes para la planificación de su futura carrera y desarrollo profesional. Esta información resulta imprescindible para la realización de los siguientes Módulos de Empleabilidad, por lo que se constituye en prerrequisito para recibir cualquiera de los siguientes módulos
Este módulo se llevará a cabo en una sesión de 30 minutos aproximadamente.

Módulo 2: Corrección Curricular:
La corrección será llevada a cabo por Consultores de Empleabilidad de Trabajando.com o en conjunto con el cliente, donde se trabajarán aspectos tales como el contenido, ortografía, extensión, formato, estructura, foco y uso de tiempos. La corrección puede ser presencial (en la misma sesión que el módulo 1), o no presencial; bajo la modalidad no presencial el Cliente deberá enviar en un plazo de 5 días hábiles la información curricular y el consultor en función de la información recabada en el módulo 1 le facilitará corregido el CV vía correo electrónico en un plazo máximo de 5 días hábiles.

Módulo 3: Claves para realizar una correcta búsqueda de Empleo:
El objetivo de este módulo consiste en dotar al Cliente de unas guías adecuadas para realizar una búsqueda de empleo eficiente. Por medio de documentación y una sesión de aproximadamente 20 minutos se establecerá en base al perfil del Cliente los medios y alertas más adecuados.

Módulo 4: Análisis Perfil Laboral:
El objetivo de este módulo consiste en aumentar el autoconocimiento que tiene el cliente sobre determinados aspectos de su perfil psicológico y sus posibles implicancias en el mundo laboral. El servicio no incluye la realización ni entrega de un informe psicológico, ni está orientado a sugerir maneras de contestar a pruebas psicológicas. El servicio se entrega mediante 2 sesiones que pueden ser conjuntas. En la primera sesión de 30 minutos aproximadamente, uno de los consultores de empleabilidad de Trabajando.com evalúa al cliente por medio de la aplicación de test y/o entrevistas estructuradas, en función del perfil del Cliente. En la segunda sesión de 20 minutos aproximadamente, se entrega feedback verbal sobre los hallazgos más significativos y se analiza en conjunto con el cliente las implicaciones que los aspectos discutidos han tenido o podrían tener en el desempeño laboral del cliente.
Durante el feedback no está permitido ningún tipo de registro (grabadora, teléfono, etc), que no sea escrito.

Módulo 5: Entrenamiento para Entrevistas:
El objetivo de este módulo consiste en la revisión de la experiencia laboral del Cliente para identificar experiencias concretas que le permitan enfrentar de una manera más efectiva las entrevistas utilizadas por empleadores en los procesos de selección de personal. El Consultor de Empleabilidad, utilizando la información recolectada en los módulos anteriores, mas información nueva proporcionada por el Cliente durante la realización del módulo, utilizará herramientas tales como “role playing” de entrevista competencial y entregará retroalimentación respecto al desempeño del Cliente en dicha actividad, para luego entregar recomendaciones y consejos, además de material de apoyo, que le permitan enfrentar de mejor manera las entrevistas de selección. El módulo 5 se entregará en una sesión de 45 minutos aproximadamente.

Módulo 6: Red de Contacto:
El objetivo principal consiste en asesorar al cliente para que reconozca, organice y potencie su propia red de contactos, desarrollando elementos óptimos de autopromoción (marketing personal, empoderamiento, carta de presentación y plan rofesional), habilidades sociales y espacios de aprendizaje; que favorecerán el desarrollo y mantención de su propia red de contactos.
El Consultor de Empleabilidad brindará espacios de aprendizaje y seguimiento (ejercicios conductuales y rol playing) para el entrenamiento de habilidades comunicativas y relacionales que favorezcan el desarrollo de su propia red.
La estructura del servicio de red de contacto se desarrollará en dos fases:

• Fase 1: En este módulo el consultor trabajará aspectos teóricos sobre la red de contacto y ejercicios prácticos para que el cliente los desarrollé de manera individual. Estos últimos, serán revisados por el consultor en los dos siguientes módulos.
• Fase 2: El consultor revisará en este módulo los ejercicios planteados en la fase 1, brindando consejo y ayuda ante las dudas o errores del cliente.

El consultor cerrará el proceso, dando espacio al cliente para dudas o nuevos consejos.

Módulo 7: Plan de Acción:
El objetivo de este módulo es trazar en conjunto con el Consultor de Empleabilidad un plan de acción que permita al Cliente hacer seguimiento de la puesta en práctica de los conocimientos adquiridos.

SEXTO:
Las obligaciones del presente contrato se extinguirán una vez ocurrida alguna de las siguientes situaciones, no implicando la restitución del precio pagado en ningún caso:

• El servicio de consultoría haya sido realizado y concluido satisfactoriamente según las condiciones estipuladas en los puntos SEGUNDO y TERCERO del presente contrato.
• Por cualquiera de las siguientes causales de incumplimiento:
  1. La no presentación a la hora y fecha acordada con el consultor de empleabilidad, sin dar aviso previo a la sesión.
  2. Cuando el cliente no entregue, previa explicita petición del consultor, la información requerida y necesaria para la correcta prestación de cualquiera de los módulos de consultoría contratados.

SÉPTIMO:
Para re-agendar cualquier Módulo de Empleabilidad contratado, el Cliente deberá dar aviso por correo electrónico o vía telefónica a su Consultor de Empleabilidad designado, con al menos 48 horas de anticipación (considerando días hábiles) a la hora acordada para el desarrollo del mismo. En caso de dar aviso dentro del plazo señalado, podrá re-agendar su sesión sin ningún costo extra. La posibilidad de re-agendar sin costo adicional será válida por 2 oportunidades. Si el Cliente solicitase re-agendar una misma sesión por tercera vez, deberá pagar un extra correspondiente al 15% del valor del servicio contratado, de lo contrario, el módulo se considera realizado. Los re-agendamientos o congelación del servicio podrán realizarse con hasta 120 días naturales desde la fecha original del módulo en cuestión, después del plazo establecido el servicio se considera realizado en su totalidad.

OCTAVO:
En el caso de que el Cliente no se presente en la fecha y hora acordadas, o presente un retraso mayor a 15 minutos, para el desarrollo de algún Módulo de Empleabilidad contratado, y da aviso oportuno (hasta 12 horas después de la hora acordada), tiene una única oportunidad (por una sola vez, en todo el proceso de Job Hunter) de re-agendar la sesión. Si no diera aviso por escrito oportuno, el servicio se considera realizado, y en consecuencia el monto cancelado no será restituido bajo ninguna circunstancia. Si el Cliente decidiese re-contratar el mismo servicio dentro de los 30 días posteriores a la fecha inicialmente acordada, se le aplicará un descuento del 50% del valor original del módulo.

NOVENO:
En caso de disconformidad sobre algún servicio, se establece un plazo de 48 horas hábiles a contar del término del servicio para dar a conocer la situación por escrito a su consultor, y en caso de que se justifique proceder a la repetición del servicio.
El presente contrato se interpretará y regirá conforme a la legislación española. Trabajando.com y el usuario se comprometen a intentar resolver de manera amistosa cualquier desacuerdo que pudiera surgir en el desarrollo del presente Contrato, previamente a acudir a la jurisdicción contemplada.
El usuario conoce y acepta que este Contrato y las reclamaciones y responsabilidades que de él se deriven, están sujetos a la legislación española. Por ello acuerda que todo litigio, discrepancia, cuestión o reclamación resultantes de la ejecución o interpretación del presente Contrato o relacionados con él, directa o indirectamente, se resolverán definitivamente en los Juzgados y Tribunales de Madrid (España) con expresa renuncia a cualquier otro fuero que en derecho pudiera corresponderle.
